Introduction

This document, together with any other documents referred to, sets out Cwt Tatws’ Terms and Conditions of Trading.
We may update these Terms and Conditions of Trading (and any documents referred to in them) from time to time, and will notify such changes by uploading them on our website. By using our website www.cwt-tatws.co.uk you agree to be bound by these Terms and Conditions of Trading.

Definitons and Identity

Cwt Tatws is the trading name of Daloni Owen, Fferm Towyn, Tudweiliog, Pwllheli, Gwynedd, LL53 8PD. Our shop is based in the Cwt Tatws, on the farm.

You our customer: the person who buys or agrees to buy goods from Cwt Tatws.

Supplier any third party from whom Cwt Tatws has bought or procured goods or services for re-sale to you.

Goods the articles which you agree to buy from Cwt Tatws.

Price the price for the goods

Prices shown do not include delivery charges but are inclusive of VAT which is currently charged at 20%, and may vary from time to time.

Postage and packing will be added at checkout.

Cwt Tatws reserves the right to change any advertised prices at any time.

Accessing our website

Access to our website is permitted on a temporary basis, and we reserve the right to withdraw or amend the services we provide through the site without notice. We will not be liable if for any reason the site is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the site, or the entire site.

Copyrights and ownership

This website and its contents are owned by Cwt Tatws. Any use of the website or it’s contents including copying and storing images without prior permission for commercial purposes is prohibited. You may not modify, delete, distribute or post anything on this website for any purpose.

Payment

Payments for orders through the website can be made through Paypal. Payment will be debited from your account immediately on placing the order.
Alternatively order via phone on 01758 770 600 where we can take your order and payment details.
Cwt Tatws offers a fully secure system for payment.

Delivery

Postage on most items is charged at £4.95, however if the item is bulky, there will be an additional delivery charge which we will confirm with you before dispatch.

Normally goods will be dispatched within 2 working days of your order if the products are in stock, or sooner where possible. (Not including Bank holidays and weekends on Mainland UK).  We deliver by Royal Mail, Delsol and courier. Should any of the products not be in stock, you will be advised of an approximate delivery date. Please be clear with regard to your address, as additional charges for re delivery will be incurred by yourself.

However some items may be out of stock or on special order. In this instance it may take up to 30 days to deliver your goods. Once we despatch the goods we cannot be liable for any delay by post and to this extent we will not enter into any compensation agreement due to the late delivery of any item. Delivery information is provided for guidance only, and is non binding.

Sale and discounts conditions

Orders placed during our sales cannot be back or forward dated.

Cancellation

You have the legal right to cancel your order within seven working days of receiving the goods under the Distance Selling Regulations. However, returning the goods to us in the condition they were dispatched in is your responsibility and, and at your cost. We reserve the right to refuse the return of goods not in such condition. We similarly reserve the right to offer an exchange or a refund at our discretion.

Returns Policy

If you wish to return an item, we need to receive it back into our store, in the condition in which it was despatched, within twenty eight days of receipt for a refund or exchange. We ask that you please return the items with their original saleable packaging. This does not affect your statutory rights. As the goods are your responsibility until they reach our store please ensure you package your return to prevent any damage to the items or boxes.

We reserve the right to refuse the return of goods which have been damaged because they were not appropriately re-packaged

With the exception of faulty and damaged goods we are not responsible for the return postage and do advise that you obtain a certificate of postage in case the parcel fails to reach us.

If you wish to cancel your order and return it to us, under the Distance Selling Regulations, you must let us know within seven working days of receiving your parcel. This can be done by calling us 01758 770 600 or via email at daloni@cwt-tatws.co.uk. You will then need to return the whole order to us, at your own expense if you have already received it.

Please note that it can take up to 21 days to process a return.

We recommend that you obtain a Certificate of Posting in case for whatever reason the parcel(s) fails to reach us.

Refusal of transaction

We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion.

Risk / Title

Risk passes to you on delivery of the Goods.

Where goods are delivered direct to you by any supplier of Cwt Tatws, risk in the goods passes to you at point of delivery.

In spite of delivery having been made, property in the Goods shall not pass from Cwt Tatws until you have paid the Price plus VAT in full.

This means that all goods remain the property of Cwt Tatws until paid for IN FULL.

Until such time as property in the Goods passes from Cwt Tatws you shall upon request deliver up the Goods to us. If you fail to do so Cwt Tatws or its representatives may enter upon any premises owned occupied or controlled by you where the Goods are situated and repossess the Goods or other property to an equivalent value.

Data Privacy

Customer information is kept strictly confidential on secure encrypted servers. Cwt Tatws does not retain credit card information and we do not and will not pass your details on to any third party.

We abide by the requirements of the Data protection act 1998.

WEEE Regulations

The Waste Electrical and Electronic Equipment (WEEE) Directive is now UK law. The regulations mean that suppliers of equipment like high street shops and internet retailers must allow consumers to return their waste equipment free of charge.

The amount of WEEE we throw away is increasing by around 5% each year, making it the fastest growing waste stream in the UK. Recycling reduces the environmental and health risks associated with sending electrical goods to landfill.

We are obliged under these regulations to offer our customers free take-back of their WEEE on a like-for-like basis when they buy a new Electrical or Electronic product from us.

Customers must return their like-for-like WEEE item to us within 28 days of purchasing their new item. Under the WEEE Regulations, all new electrical goods should be marked with the crossed-out wheeled bin symbol and be disposed of separately from normal household waste.

You can recycle your old electricals with us.

Just pop the item in the post and return it to: Cwt Tatws, Fferm Towyn, Tudweiliog, Pwllheli, Gwynedd, LL53 8PD.  Alternatively if would prefer you can bring it us at the same address and we will dispose of it for you. All postage and packaging is to be paid for by the customer for the returned recyclable item.

Waiver

Cwt Tatws’ rights shall not be prejudiced or restricted by any indulgence or forbearance extended by it to you, and wavier of any particular breach shall not operate as a waiver of any subsequent breach.

Severance

Any provision of this contract which is or may be void or unenforceable shall to the extent of such invalidity or unenforceability be deemed severable and shall not affect any other provision of this contract.

General

Cwt Tatws warrants that the Goods supplied will at the time of delivery correspond to the description given on this website. Except where the Buyer is dealing as a consumer (as defined in the Unfair Contract Terms Act 1977 Section 12 and/or the Unfair Terms in Consumer Contracts Regulations 1999 Regulation 3(1)) all other warranties, conditions or terms relating to fitness for purpose, quality or condition of the Goods, whether express or implied by statute or common law or otherwise are excluded to the fullest extent permitted by law.

Cwt Tatws shall be under no liability whatever for any indirect loss and/or expense arising out of a breach by us of this contract.

In the event of any breach of this contract by us, your remedies shall be limited to damages. Under no circumstances shall our liability exceed the greater of the price of the particular item(s) supplied or the amount of any valid insurance available to meet the claim.

Cwt Tatws shall not be liable for failure or delay in fulfilling any of its obligations, where fulfilment therefore is prevented, frustrated, impeded, delayed or rendered uneconomic by circumstances or events beyond its reasonable control.

The provisions of the Contracts (Rights of Third Parties Act) 1999 shall not apply to this contract and a person who is not a party to this contract shall have no right under that Act to enforce any term of the contract.

Neither party shall be liable for any default due to any act of God, war, civil disturbance, malicious damage, strike, lockout, industrial action, fire, flood, drought, extreme weather conditions, compliance with any law or governmental order, rule, regulation, direction or other circumstance beyond the reasonable control of either party (‘Force Majeure Event’).
Each party shall give notice forthwith to the other upon becoming aware of a Force Majeure Event: the notice to specify details of the circumstances giving rise to the Force Majeure Event.

These conditions and all agreements between Cwt Tatws and you shall be governed by, and constructed in accordance with the Laws of England and Wales and any disputes shall be subject to the exclusive jurisdiction of the Courts of England and Wales.
